Welcome to fabsroofing.com. These Terms and Conditions (“Terms”) govern your access to and use of our website, as well as the general terms under which Fab’s Roofing (“we,” “us,” or “our”) provides roofing services, inspections, and estimates.
Please read these Terms carefully before using our website or engaging our services. By accessing this website or hiring Fab’s Roofing, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
1. Services Provided
Fab’s Roofing provides residential and commercial roofing services in the City of Miami, Miami-Dade County, and surrounding areas. Our services include, but are not limited to:
- Roof replacements and installations (tile, shingle, metal, flat/TPO, etc.)
- Roof repairs and leak detection
- Emergency roof tarping and storm damage mitigation
- Roof inspections (Real Estate, Wind Mitigation, 4-Point)
- Preventive maintenance
All work is subject to the specific terms outlined in your individual written proposal and contract.
2. Estimates and Proposals
- Binding Agreements: A verbal estimate or a website inquiry does not constitute a binding contract. A binding agreement is only formed when you sign a formal written proposal provided by Fab’s Roofing.
- Validity: Estimates provided are valid for 30 days from the date of issuance, as material costs and availability can fluctuate.
- Hidden Damage: Roofing estimates are based on the visible conditions of the roof at the time of inspection. If we discover unforeseen damage (e.g., rotted decking, compromised structural framing, or outdated wiring) once the tear-off has begun, we will provide you with a Change Order outlining the additional costs before proceeding with that specific portion of the work.
3. Permits and HVHZ Compliance
- Permitting: Fab’s Roofing will obtain the necessary building permits from the City of Miami Building Department (or applicable municipality) for your project. The cost of standard permits is typically included in your proposal unless otherwise stated.
- HVHZ Standards: All roofing installations and repairs will be performed in strict accordance with the Florida Building Code and Miami-Dade County High-Velocity Hurricane Zone (HVHZ) requirements. We utilize materials with valid Miami-Dade Notices of Acceptance (NOAs).
- Inspections: Final payment may be contingent upon the roof passing the required municipal inspections.
4. Payment Terms
- Deposits: A deposit is required prior to ordering materials and scheduling the project. The amount will be specified in your contract.
- Progress Payments: For larger projects, progress payments may be required based on the completion of specific milestones (e.g., tear-off, dry-in, installation).
- Final Payment: Final payment is due immediately upon substantial completion of the work and/or final inspection approval.
- Financing: We offer third-party financing options. Approval and terms are governed by the respective lending institution.
5. Warranties
- Workmanship Warranty: Fab’s Roofing provides a limited workmanship warranty on installations, the terms of which are detailed in your service contract.
- Manufacturer Warranties: Material warranties (e.g., shingle, tile, TPO membrane) are provided directly by the manufacturer. Fab’s Roofing will register your warranty where applicable, but we do not independently guarantee the materials beyond the manufacturer’s written terms.
- Voiding Warranties: Warranties may be voided if the roof is modified, walked on improperly, subjected to unauthorized repairs by third parties, or damaged by severe acts of nature (hurricanes, tornadoes) that exceed the building code design limits.
6. Insurance Claims & Storm Damage
- Fab’s Roofing provides documentation (photos, reports) to assist homeowners with insurance claims for storm damage.
- We are not a public adjuster, and we do not negotiate insurance settlements.
- We cannot guarantee that your insurance company will approve or cover any portion of your claim. The homeowner is responsible for all deductibles and any costs not covered by insurance.
7. Delays and Weather Conditions
Roofing is highly weather-dependent. While we strive to complete all projects promptly, Fab’s Roofing is not liable for delays caused by circumstances beyond our control, including but not limited to:
- Severe weather (heavy rain, high winds, lightning, hurricanes).
- Delays in municipal permitting or inspections.
- Material shortages or backorders from manufacturers.
- Acts of God or other force majeure events.
8. Limitation of Liability
- Interior Damage: While we use industry-standard protective measures (tarping, drop cloths), roof work can be inherently messy. Fab’s Roofing is not liable for minor dust or debris. Furthermore, we are not liable for pre-existing interior water damage or damage caused by active leaks that occur before we are contracted to mitigate them.
- Consequential Damages: To the maximum extent permitted by Florida law, Fab’s Roofing shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use of our website or services.
9. Cancellation Policy
The cancellation policy, including the right to cancel (Florida’s 3-day right to cancel for certain contracts), is outlined in your specific signed contract. Please refer to your contract for specific details on refunds for materials already ordered or custom-made.
10. Website Use and Intellectual Property
All content on this website—including text, graphics, logos, images, and code—is the property of Fab’s Roofing and is protected by copyright and trademark laws. You may not reproduce, distribute, or use our content without express written permission.
11. Governing Law
These Terms and the provision of our services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action arising from these Terms or your use of our services shall be filed in the state or federal courts located in Miami-Dade County, Florida.
12. Changes to These Terms
We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the website or services following any changes constitutes your acceptance of the revised Terms.
